Welcome to Gemini Servers. These Terms of Use ("Terms") govern your access to and use of the Gemini Servers website, services, and applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility and Account Registration

2. User Content and Conduct

2.1 User-Generated Content

The Service allows you to create, upload, post, and share content including but not limited to: server listings, reviews, comments, messages, profile information, brand pages, news articles, events, and media ("User Content").

You retain ownership of your User Content. However, by posting User Content, you grant Gemini Servers a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, distribute, and perform your User Content in connection with operating and improving the Service.

2.2 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

  • You own or have the necessary rights to post the content
  • Your content does not infringe any third-party rights
  • Your content complies with all applicable laws

2.3 Prohibited Content and Conduct

You agree NOT to post, upload, or transmit any content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
  • Is hateful or discriminatory based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or age
  • Contains sexually explicit material involving minors
  • Infringes any patent, trademark, copyright, trade secret, or other proprietary rights
  • Contains viruses, malware, or any harmful code
  • Is spam, phishing, or fraudulent in nature
  • Impersonates any person or entity
  • Promotes illegal activities or violence
  • Violates any applicable laws or regulations

You further agree NOT to:

  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated tools, bots, or scripts without authorization
  • Collect user information without consent
  • Circumvent any security or access restrictions
  • Use the Service for any commercial purpose without authorization
  • Manipulate voting, reviews, or ranking systems

2.4 Content Moderation

Gemini Servers reserves the right, but has no obligation, to monitor, review, edit, or remove any User Content at our sole discretion. We may remove content that violates these Terms, is objectionable, or for any other reason. Moderation decisions are made at our discretion and are generally final, though users may appeal through our designated process.

3. Platform Features and Services

3.1 Game Server Listings

The Service allows users to list and discover game servers for various platforms including Minecraft, Discord, Valheim, Terraria, and others. Server owners are responsible for the accuracy of their listings and compliance with these Terms. Gemini Servers does not operate or control third-party game servers and is not responsible for their content, availability, or conduct.

3.2 Brand and Organization Pages

Users may create pages for brands, organizations, or communities. Brand page administrators are responsible for their page content and must comply with these Terms. Features may include newsletters, polls, team member profiles, media galleries, and contact forms.

3.3 Social Features

The Service includes social features such as:

  • User profiles and customization
  • Friends and followers systems
  • Direct messaging between users
  • Comments and reactions
  • Activity feeds and notifications
  • Content sharing

Users must use these features responsibly and in accordance with these Terms. Harassment or abuse through these features is prohibited.

3.4 Reviews and Ratings

Users may submit reviews and ratings for pages and content. Reviews must be honest, based on genuine experience, and comply with our content guidelines. Manipulating reviews, including fake positive or negative reviews, is prohibited and may result in account termination.

3.5 Events and Applications

Users may create events, recruitment postings, and application forms. Event organizers and recruiters are responsible for their listings and communications with applicants. Gemini Servers is not responsible for any arrangements made between users.

3.6 Giveaways

Users may host giveaways through the Service. Giveaway hosts are solely responsible for fulfilling prizes and complying with all applicable laws regarding contests and giveaways. Gemini Servers does not sponsor, endorse, or guarantee any giveaways.

4. Payments and Virtual Currency

4.1 Paid Services

The Service may offer paid features including but not limited to: advertising placements, subscription services, and premium features. By purchasing paid services, you agree to pay all applicable fees.

4.3 Advertising

Users may purchase advertising placements on the Service. Advertisements must comply with these Terms and our advertising policies. We reserve the right to reject, remove, or require modifications to any advertisement at our discretion.

4.4 Subscriptions

Some features may require a subscription. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel subscriptions through your account settings. Cancellation takes effect at the end of the current billing period.

4.5 Billing and Payment Processing

Payments are processed through third-party payment processors (such as Stripe). By making a purchase, you agree to the payment processor's terms. You are responsible for providing accurate billing information and ensuring sufficient funds.

4.6 Refunds

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEMINI SERVERS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, OR (B) ONE HUNDRED DOLLARS ($100).

11. Account Termination

You may close your account at any time through your account settings or by contacting us. Upon closure, your right to use the Service terminates immediately.

11.2 Termination by Us

We may suspend or terminate your account at any time, with or without cause or notice, including for violations of these Terms. We may also remove any User Content at our discretion.

11.3 Effect of Termination

Upon termination:

  • We may delete your account and User Content
  • Any virtual currency or paid features are forfeited
  • Provisions that by their nature should survive termination will survive (including indemnification, limitation of liability, and dispute resolution)

If your account is suspended or terminated, you may submit an appeal through our designated appeal process. Appeals are reviewed at our discretion, and our decision is final.

12. Dispute Resolution

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Gemini Servers regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

13.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

13.5 Updates to Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or via email. Continued use after changes constitutes acceptance of the updated Terms.
